1. Our Services #

LendingFounder is a financing comparison service. We are not a lender, a broker of record, an insurer, or a credit repair organisation, and we make no credit decisions: when you send a request, we share it with network partners who may contact you about their options. The information provided when using the Services is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation.

2. Intellectual property rights #

We are the owner or the licensee of all intellectual property rights in our Services, including all source code, databases, functionality, software, website designs, text, and graphics in the Services (collectively, the “Content”), and the trademarks and logos in them (the “Marks”). The Content and Marks are provided “AS IS” for your personal, non-commercial use or internal business purpose only. Partner names and logos shown on the Services belong to their respective owners.

3. User representations #

By using the Services, you represent and warrant that: (1) you have the legal capacity and agree to comply with these Legal Terms; (2) you are not a minor in the jurisdiction in which you reside; (3) you will not access the Services through automated or non-human means; (4) you will not use the Services for any illegal or unauthorized purpose; (5) the information you submit in a request is true, accurate, and yours to give; and (6) your use of the Services will not violate any applicable law or regulation.

4. Prohibited activities #

You may not access or use the Services for any purpose other than that for which we make them available. As a user of the Services, you agree not to systematically retrieve data or content to compile a database or directory; submit requests with information that is not your own or that you are not authorised to give; trick, defraud, or mislead us or other users; circumvent, disable, or interfere with security features of the Services, including the automated-submission checks on our forms; use the Services to harass, abuse, or harm another person; or use the Services in a manner inconsistent with any applicable law or regulation.

5. Services management #

We reserve the right, but not the obligation, to monitor the Services for violations of these Legal Terms; to take appropriate legal action against anyone who violates the law or these Legal Terms; and to otherwise manage the Services in a manner designed to protect our rights and property and to facilitate their proper functioning. Submissions identified as automated abuse are filed for review rather than processed as requests.

6. Term and termination #

These Legal Terms remain in full force and effect while you use the Services. We reserve the right, in our sole discretion and without notice or liability, to deny access to and use of the Services to any person for any reason, including breach of these Legal Terms or of any applicable law.

7. Modifications and interruptions #

We reserve the right to change, modify, or remove the contents of the Services at any time and for any reason at our sole discretion, without notice. We cannot guarantee the Services will be available at all times: we may experience hardware, software, or other problems, or need to perform maintenance, resulting in interruptions, delays, or errors.

8. Governing law #

These Legal Terms and your use of the Services are governed by and construed in accordance with the laws of the United States and of the state in which LendingFounder is organised, without regard to conflict of law principles.

9. Disclaimer #

THE SERVICES ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE SERVICES WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICES AND YOUR USE THEREOF. LendingFounder is not a lender; offers come from partners who may compensate us; eligibility depends on each provider's terms; and sending a request does not guarantee approval of any product.

10. Limitations of liability #

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES, INCLUDING ANY DECISION MADE OR ACTION TAKEN IN RELIANCE ON INFORMATION SHOWN ON THEM.

11. Indemnification #

You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys' fees and expenses, made by any third party due to or arising out of your use of the Services or breach of these Legal Terms.

12. SMS communications program #

By checking the consent box in one of our request flows, you expressly authorize LendingFounder and its network partners to contact you at the number you provided, including by text message; the exact wording you agree to is shown on the form and stored with your request.

• Opt-out: you can cancel at any time by replying STOP to the number from which you received the message. After that you will no longer receive SMS messages from us; to join again, submit a new request as you did the first time.
• Customer support: reply HELP to any message, email info@lendingfounder.com, or use the contact form on the Site.
• Carrier liability: mobile carriers are not liable for delayed or undelivered messages.
• Rates and frequency: message and data rates may apply, and message frequency varies. For questions about your text or data plan, contact your wireless provider.
• Age restriction: you must be at least 18 years of age to use the Services and opt in to receive SMS messages.

13. Miscellaneous #

These Legal Terms and any policies posted on the Services constitute the entire agreement and understanding between you and us. Our failure to exercise or enforce any right or provision of these Legal Terms shall not operate as a waiver of such right or provision. If any provision of these Legal Terms is determined to be unlawful, void, or unenforceable, that provision is deemed severable and does not affect the validity and enforceability of the remaining provisions.
